GRANDPARENT'S RIGHTS IN FLORIDA


The rights of a Grandparent to custody and visitation of their grandchildren and great-grandchildren is very limited in Florida.A Grandparent’s Rights Bill is in the process of becoming law the Florida Legislature. After the last legislative session in 2015, the Bill went to the Governor’s desk for a decision.

HB 149 would allow grandparents the right to request visitation with their grand and great-grandchildren when a “dependency” case is in progress. A “dependency” case is an action taken by the Department of Children and Families in which children are removed from the home by the Department’s protective services.

According to the Bill, when a dependency case is in progress, the removed children’s grandparents would be allowed to file an action with the Court to be allowed to see their grandchildren.Please see our website for updates regarding grandparent’s right in Florida.
