Misdemeanors are crimes that are punishable by up to one year in county jail.
There are ‘levels’ of misdemeanors and classified as first degree (more serious), or second degree(less serious).
First Degree Misdemeanor
Misdemeanors of the first degree = jail time of up to one year and fines of up to $1,000.
Example of a First Degree misdemeanor; Theft of property valued at $100 or more, but less than $300, First Offense DUI
Misdemeanors of the Second Degree
Misdemeanors of the second degree = jail time of up to 60 days and a fine of up to $500.
Example of 2nd degree misdemeanor; Criminal Mischief under $200.
Statute of Limitations for Misdemeanors
The State Attorney (Prosecutor) must begin criminal prosecution within a certain amount of time, called the statute of limitations. If they do not, then the case can be dismissed. The statute of limitations ‘clock’ begins ticking when the crime is committed. Misdemeanors in Florida have statutes of limitations of one or two years.
